In Florida children have the right to be supported by both parents equally. In some cases this results in the father paying child support, but it may also result in the mother paying child support. The court considers the parents’ income, the children’s expenses, and how many overnight stays the children spend with each parent when determining who will pay child support and how much they will pay.
In Florida a parent cannot waive their right to child support. This is because the child support money is for the children – not for the parent – and the parent cannot waive the child’s right to support. Because the child support money is for the needs of the child, the receiving parent is not allowed to spend the money for their own personal use.
